Default How to get married in Spain

Please bear in mind that the following are the requirements for getting married at the Civil registry which is part of the Arona law courts. There is not a registry in Adeje so it covers that area too. The requirements do vary from district to district so you need to ask for a list of requirements from the registry where you intend to get married. These requirements apply to everyone whether it is a heterosexual or homosexual couple getting married.


Requirements

EVERYONE

Birth certificate
Certificate of empriadionamiento covering the previous 2 years
Fe de estado or sworn declaration of marital status
photo copy of DNI/NIE/Passport


DIVORCEES

As above plus
Previous marriage certificate and proof of divorce


WIDOW/ERS

As per everyone plus
Marriage certificate
Death certificate of spouse

FOREIGNERS

As per section one depending of marital status
Translated and legallised as appropriate
Documentary evidence of the home Country's requirements for publication of intent to marry and compliance with the same.
Certificate of fitness to marry

The Consulate can translate and legalise birth certificates, provide sworn declaration of Fe de Estado and publication of the Banns within the consulate. This can be done in the South Consulate surgery if booked by prior appointment. The total cost of providing all this for 2 people is €850. It would be more for Widows and Divorcees as there would be more certificates to translate and legalise. Included in this cost is the Consulate providing the certificate of fitness to Marry.

Once you have all paperwork together you both go in person between 10 and 12.30pm with all the paperwork to the civil registry. You also need to be accompanied by the two witnesses who will be at your ceremony along with their original and copy passport plus NIE/Registro.

thank you for posting this - very interesting!! when we were ready to think about where to get married, we thought spain should be the easiest way - until we found out that everything would have to be translated into spanish and that it'd cost us a fortune.
we therefore contemplated prague (where my family lives) but my husband would have had to go through the same procedures, sending all his paperwork to the UK.
in the end we got married in the UK - all that was required from me was my passport but no birth certificate, no translations etc. it was the easiest way!

are same sex marriages recognised in the UK now? (sorry if it's a stupid question, i haven't been following this topic at all)

They are yes but are called a civil partnership and have a different status to a conventional marriage. In Spain only the civil ceremony is recognised in law and has the same status for everyone. The religious part of a marriage is not legally recognised on it's own without the civil ceremony.

850 Euros robbing barstewards... Why don't you both go back to Britain or the Caribbean and do the deed and have a nice holiday into the bargain

When we got married it was 7/6 old money ....

In the UK, when you divorce, you have to hand over your marriage certificate - sadly, I speak from experience!). Would this potentially stop UK divorcee's, as they would not be able to meet Spanish requirements?

I'm sure I know a divorcee who married here, but does anybody here know?


ps: No, I am not thinking of divorcing Geoff & re-marrying

I agree that it is extortionate however Spain is our home and we want to go through the ceremony here for a few reasons.

As I said previously in Spain same sex marriages have equal status to conventional marriages. We've never been interested in a half way house compromise as exists in the UK. Going through the ceremony here will offer protection to either of us should anything happen to the other. My understanding is that a civil union performed in the UK would not offer that protection here but I stand to be corrected if anyone knows different. Not that it would change our minds.

And in fact, the other costs will be significantly less than an equivalent ceremony in the UK ... I can imagine reception, rings, clothes, flowers, food, whatever, will be far less, so it will probably end up considerably cheaper to do here despite the Consulate costs.

Credit due to you too for the information in this thread Janet. I went to find out what is required but you have dealt with the Consulate on crossing the T's.

That´s a bit onerous - presumably if one of the witnesses is sick on the day, the ceremony has to wait.

That crossed my mind too. Also what if they decided to move back to the UK before the ceremony goes ahead. I intend to ask when we present the papers.
