A report commissioned by the High Court in the Canaries has decreed that El Marqués is in complete breach of coastal law. In addition, the building has a storey more than the presented project, and this added to its illegality.
The president of the neighbourhood association of Playa Paraiso, Benito Capone, said that the association had spent a long time fighting the "intolerable construction" of this complex, which is situated right on the sea edge of the prettiest point of the coast in this area. Sr Capone also said that although deemed a
commercial centre, most of the building was apartments which, in the main, had been sold to foreigners. It had, moreover, blocked access to the bathing pools and fishing areas which had been traditionally used for generations.
The building was "closed" for some time for blatant disregard of the rules, said Sr Capone, before finally being legalized, and in the face of such injustice and the continued silence of the authorities, the association had been left with no alternative other than to go to court.
